Firstly, the regulation of mistake and fraud under the Japanese Civil Code—including the new revised Civil Code—will be discussed, to clarify the requirements for each doctrine to be engaged, the relief given, and the third party protection afforded. Secondly, the regulation of misrepresentation under the Consumer Contract Act will be examined. Thirdly, a number of hypothetical questions are analysed to illustrate how Japanese law regulate the issues on mistake, fraud and misrepresentation. Finally, as a conclusion, the interrelationship between mistake, fraud and misrepresentation in Japan will be discussed. |
