概要 | The Japanese Civil Code which was enacted in 1898 comprises of ‘general provisions,’ ‘property law,’ ‘law of obligations,’ ‘family law’ and ‘law of inheritance.’ Since 2006, the ‘law of obligations’ has undergone a process of comprehensive revision. This paper examines and evaluates the proposal of the ‘Civil Code (Law of Obligations) Reform Commission’ in its 'Basic Reform Policy (Draft Proposal) 2009, to incorporate certain rules in the existing ‘Consumer Contract Act’ into the ‘Civil Code’.
